Cataluña Considering Banning Second Home Purchases

Cataluña is considering restricting property purchases to primary residences in areas with high housing demand. This proposal, supported by local authorities including Barcelona City Council, aims to curb speculative buying and ensure housing availability for residents. A legal study commissioned by the Barcelona Metropolitan Strategic Plan (PEMB) suggests that such restrictions are legally feasible if applied exceptionally and with clear territorial and temporal limits. The study also proposes exceptions, such as allowing the purchase of entire buildings if they are converted into long-term rental housing.

The proposal has garnered support from various political figures and organisations, including Janet Sanz, Vice President of PEMB, who emphasised the need for political will to implement these measures. However, the proposal has faced criticism from some sectors, with concerns that it may exacerbate the housing crisis by deterring investment and reducing the supply of rental properties.

In contrast, other regions in Spain are exploring different approaches to address housing issues. For instance, the Spanish government is considering increasing taxes on the purchase of second or third homes in areas experiencing “extreme tension” in the housing market. This measure aims to discourage speculative buying and promote the availability of housing for primary residents.

While both approaches aim to address housing affordability and availability, they differ in their strategies and potential impacts on the housing market. The effectiveness of these measures will depend on their implementation and the broader economic and social context.
